Terms of Service

1. Acceptance of these terms

These Terms of Service (“Terms”) are an agreement between you and Neil Sharma, doing business as PoppyCut (“PoppyCut,” “we,” “us”), a sole proprietorship. By creating an account or using PoppyCut, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the service.

2. The service

PoppyCut is a video editing tool: you upload video, audio, and image files, edit them in a timeline-based editor, optionally use AI features to help generate or adjust an edit, and export a finished video. Some features send parts of your content or a description of your edit to third-party AI providers to work (see Section 6).

We may add, change, or remove features, and we may suspend or stop the service (in whole or in part) at any time. We'll try to give notice for anything that materially affects you, but an early-stage product like this one can't promise uninterrupted availability.

3. Eligibility

You must be at least 13 years old to use PoppyCut. If you are under the age of majority where you live, you may only use PoppyCut with a parent or guardian's permission and under their supervision of any account and billing activity. PoppyCut is not directed at children under 13, and we do not knowingly collect personal information from children under 13 — see our Privacy Policy.

4. Accounts

You need an account to save projects. You're responsible for keeping your login credentials secure and for everything that happens under your account. Tell us right away at neilsharma425@gmail.com if you think your account has been compromised.

5. Your content

“Your Content” means the video, audio, images, text, and any other material you upload to or create with PoppyCut. You own Your Content. We don't claim ownership of it.

By uploading Your Content, you grant us a limited, worldwide, royalty-free license to host, store, process, transmit, and display it — including sending it to the AI and media providers described in Section 6 — solely to operate and provide the service to you (for example: storing your upload, running it through transcription or an AI edit you asked for, and rendering your export). This license ends when you delete Your Content or your account, except for copies kept briefly in backups or as required by law.

You're solely responsible for Your Content and for having the rights to upload and edit it — including footage of other people, licensed music, copyrighted clips, brand assets, and anything else you bring into a project. Don't upload anything you don't have the right to use.

6. AI features

PoppyCut's AI editing features work by sending relevant parts of your project — your instructions, a transcript of your video, and/or short excerpts needed to propose an edit — to third-party AI model providers, currently including Anthropic (Claude) and OpenAI. Speech-to-text transcription runs locally by default and may fall back to a hosted provider (currently Deepgram or OpenAI's hosted Whisper API) when local transcription isn't available.

As of this writing, Anthropic's and OpenAI's API terms state they do not use API inputs or outputs to train their models by default (unlike some of their free consumer products). That's their policy, not ours to guarantee — it can change, and you should review Anthropic's and OpenAI's own terms if that matters to you.

AI-assisted edits are a starting point, not a guarantee. Review anything an AI feature produces before you publish it — we're not responsible for mistakes, omissions, or anything offensive or inaccurate an AI-generated suggestion introduces into your video.

PoppyCut also runs local, on-device-style face detection (bounding boxes, to help frame a shot) on video you upload. This is not facial recognition — we do not identify who is in your videos, build biometric identity profiles, or share face data with third parties for identification purposes.

7. Third-party media libraries

PoppyCut lets you search and import stock video, photos, and sound effects from third-party libraries (currently Pexels, Pixabay, and Freesound). Content from these libraries is subject to their license terms, not ours — you're responsible for complying with the applicable license (including any attribution requirements) for anything you import and use in a published video.

8. Acceptable use

You agree not to use PoppyCut to:

  • Upload or create content that's illegal, infringing, defamatory, or that violates someone else's privacy or publicity rights;
  • Upload content depicting csam, or that sexually exploits or endangers minors in any way;
  • Create non-consensual intimate imagery or deceptive “deepfake” content of real people intended to mislead or harass;
  • Infringe anyone's copyright, trademark, or other intellectual property rights;
  • Interfere with, overload, or attempt unauthorized access to the service or other users' accounts;
  • Use the service to build a competing product by systematically scraping it; or
  • Violate any applicable law.

We can suspend or terminate accounts that violate this section, remove content that violates it, and report unlawful content (including CSAM) to the relevant authorities as required by law.

We respect intellectual property rights and expect you to as well. If you believe content on PoppyCut infringes your copyright, send a notice that satisfies the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)) to our designated agent:

10. Fees

PoppyCut is currently in preview. Every account receives 100 free credits (100 credits = $1) to use AI editing features, charged for the actual cost of the underlying AI provider call — a longer or more complex edit request costs more credits than a short one. Once your credits reach zero, AI editing is paused until you have more; the rest of the editor (manual timeline editing, captions, exporting what you've already built) keeps working. We do not charge you automatically when your free credits run out — no payment method is required during preview, and nothing converts to a paid subscription without your action.

Paid plans described on our pricing page, and the ability to buy more credits, are not live yet. Pricing, billing terms, and a refund policy will be added here before either goes live.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. AI-GENERATED SUGGESTIONS AND EDITS MAY BE INACCURATE — YOU ARE RESPONSIBLE FOR REVIEWING ANYTHING YOU PUBLISH.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPPYCUT AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) [$100 — placeholder cap for a free product; revisit once paid plans exist]. Some jurisdictions don't allow these limitations, so some of this may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold PoppyCut and its operators harmless from any claim, damages, or expense (including reasonable attorneys' fees) arising from Your Content, your violation of these Terms, or your violation of any third party's rights.

14. Termination

You can stop using PoppyCut and delete your account at any time. We can suspend or terminate your access if you violate these Terms, or shut the service down entirely with reasonable notice. Sections that by their nature should survive termination (content license for backups, disclaimers, limitation of liability, indemnification) continue to apply after your account is closed.

15. Changes to these terms

We may update these Terms from time to time. If a change is material, we'll make reasonable efforts to notify you (e.g. an in-app notice or an email) before it takes effect. Continuing to use PoppyCut after a change takes effect means you accept the updated Terms.
